Chapter 23 is divided into four main and interconnected areas: <strong data-start=\"384\" data-end=\"468\">judiciary, fight against corruption, fundamental rights, and EU citizens\u2019 rights<\/strong>.<\/p>\n<p data-start=\"473\" data-end=\"1054\">Establishing an independent and efficient judiciary requires a strong commitment from all societal and political actors to eliminate external influences on the judiciary, as well as providing financial and other resources for the proper functioning of the judicial system. An effective fight against corruption is also expected, with a particular emphasis on <strong data-start=\"832\" data-end=\"857\">high-level corruption<\/strong>, along with ensuring the protection and full enjoyment of fundamental rights and EU citizens\u2019 rights. Implementing reforms in these areas directly strengthens the <strong data-start=\"1021\" data-end=\"1036\">rule of law<\/strong> in the country.<\/p>\n<hr data-start=\"1056\" data-end=\"1059\" \/>\n<p data-start=\"1061\" data-end=\"1076\"><strong data-start=\"1061\" data-end=\"1074\">Sub-areas<\/strong><\/p>\n<p data-start=\"1078\" data-end=\"1093\"><strong data-start=\"1078\" data-end=\"1091\">JUDICIARY<\/strong><\/p>\n<p data-start=\"1095\" data-end=\"1243\">The judiciary is a particular focus of the EU, given that a stable judicial system is essential for the rule of law. This area has four sub-areas:<\/p>\n<ol data-start=\"1244\" data-end=\"1455\">\n<li data-start=\"1244\" data-end=\"1299\">\n<p data-start=\"1247\" data-end=\"1299\"><strong data-start=\"1247\" data-end=\"1297\">Independence and impartiality of the judiciary<\/strong><\/p>\n<\/li>\n<li data-start=\"1300\" data-end=\"1332\">\n<p data-start=\"1303\" data-end=\"1332\"><strong data-start=\"1303\" data-end=\"1330\">Judicial accountability<\/strong><\/p>\n<\/li>\n<li data-start=\"1333\" data-end=\"1401\">\n<p data-start=\"1336\" data-end=\"1401\"><strong data-start=\"1336\" data-end=\"1399\">Professionalism, expertise, and efficiency in the judiciary<\/strong><\/p>\n<\/li>\n<li data-start=\"1402\" data-end=\"1455\">\n<p data-start=\"1405\" data-end=\"1455\"><strong data-start=\"1405\" data-end=\"1453\">Prosecution of war crimes in domestic courts<\/strong><\/p>\n<\/li>\n<\/ol>\n<p data-start=\"1457\" data-end=\"1848\">Montenegro is expected to implement comprehensive reforms in the judicial system, ensure full alignment with EU law, and achieve measurable results in implementation. According to the <strong data-start=\"1641\" data-end=\"1692\">European Commission\u2019s 2024 Report on Montenegro<\/strong>, the Montenegrin judicial system is moderately prepared, with good progress made in key judicial reforms and in implementing last year\u2019s recommendations.<\/p>\n<hr data-start=\"1850\" data-end=\"1853\" \/>\n<p data-start=\"1855\" data-end=\"1885\"><strong data-start=\"1855\" data-end=\"1883\">FIGHT AGAINST CORRUPTION<\/strong><\/p>\n<p data-start=\"1887\" data-end=\"2328\">The fight against corruption has been a key EU focus since the start of negotiations. Obligations in this area stem not only from EU law but also from international standards such as those of the <strong data-start=\"2083\" data-end=\"2125\">UN, Council of Europe, OSCE, and GRECO<\/strong>. Montenegro is expected to fully align national legislation with these standards and demonstrate readiness to achieve visible results in both <strong data-start=\"2268\" data-end=\"2306\">preventive and repressive measures<\/strong> against corruption.<\/p>\n<p data-start=\"2330\" data-end=\"2568\">According to the <strong data-start=\"2347\" data-end=\"2384\">European Commission\u2019s 2024 Report<\/strong>, Montenegro is at an <strong data-start=\"2406\" data-end=\"2456\">intermediate to moderate level of preparedness<\/strong> in the fight against corruption, with good progress in implementing key reforms and previous recommendations.<\/p>\n<hr data-start=\"2570\" data-end=\"2573\" \/>\n<p data-start=\"2575\" data-end=\"2599\"><strong data-start=\"2575\" data-end=\"2597\">FUNDAMENTAL RIGHTS<\/strong><\/p>\n<p data-start=\"2601\" data-end=\"2903\">Fundamental rights are the cornerstone of any civilized society and law-governed state, and their unhindered enjoyment must be guaranteed. This area includes a range of conventions, protocols, charters, and declarations that the candidate country must introduce and implement within its legal system.<\/p>\n<p data-start=\"2905\" data-end=\"2929\">The sub-areas include:<\/p>\n<ul data-start=\"2930\" data-end=\"3280\">\n<li data-start=\"2930\" data-end=\"2990\">\n<p data-start=\"2932\" data-end=\"2990\">Prevention of torture and inhuman or degrading treatment<\/p>\n<\/li>\n<li data-start=\"2991\" data-end=\"3024\">\n<p data-start=\"2993\" data-end=\"3024\">Prohibition of discrimination<\/p>\n<\/li>\n<li data-start=\"3025\" data-end=\"3057\">\n<p data-start=\"3027\" data-end=\"3057\">Promotion of gender equality<\/p>\n<\/li>\n<li data-start=\"3058\" data-end=\"3079\">\n<p data-start=\"3060\" data-end=\"3079\">Children\u2019s rights<\/p>\n<\/li>\n<li data-start=\"3080\" data-end=\"3119\">\n<p data-start=\"3082\" data-end=\"3119\">Rights of persons with disabilities<\/p>\n<\/li>\n<li data-start=\"3120\" data-end=\"3139\">\n<p data-start=\"3122\" data-end=\"3139\">Property rights<\/p>\n<\/li>\n<li data-start=\"3140\" data-end=\"3175\">\n<p data-start=\"3142\" data-end=\"3175\">Freedom of expression and media<\/p>\n<\/li>\n<li data-start=\"3176\" data-end=\"3197\">\n<p data-start=\"3178\" data-end=\"3197\">Procedural rights<\/p>\n<\/li>\n<li data-start=\"3198\" data-end=\"3231\">\n<p data-start=\"3200\" data-end=\"3231\">Protection of minority rights<\/p>\n<\/li>\n<li data-start=\"3232\" data-end=\"3251\">\n<p data-start=\"3234\" data-end=\"3251\">Cultural rights<\/p>\n<\/li>\n<li data-start=\"3252\" data-end=\"3280\">\n<p data-start=\"3254\" data-end=\"3280\">Personal data protection<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3282\" data-end=\"3524\">According to the <strong data-start=\"3299\" data-end=\"3336\">European Commission\u2019s 2024 Report<\/strong>, Montenegro has generally established the legislative and institutional framework for fundamental rights and largely continues to fulfill its <strong data-start=\"3479\" data-end=\"3521\">international human rights obligations<\/strong>.<\/p>\n<hr data-start=\"3526\" data-end=\"3529\" \/>\n<p data-start=\"3531\" data-end=\"3556\"><strong data-start=\"3531\" data-end=\"3554\">EU CITIZENS\u2019 RIGHTS<\/strong><\/p>\n<p data-start=\"3558\" data-end=\"3726\">EU citizens\u2019 rights form a distinct area where the candidate country must ensure conditions for the exercise of rights by citizens of EU member states. This includes:<\/p>\n<ul data-start=\"3727\" data-end=\"3928\">\n<li data-start=\"3727\" data-end=\"3795\">\n<p data-start=\"3729\" data-end=\"3795\">The right to vote and stand in <strong data-start=\"3760\" data-end=\"3793\">European Parliament elections<\/strong><\/p>\n<\/li>\n<li data-start=\"3796\" data-end=\"3850\">\n<p data-start=\"3798\" data-end=\"3850\">The right to vote and stand in <strong data-start=\"3829\" data-end=\"3848\">local elections<\/strong><\/p>\n<\/li>\n<li data-start=\"3851\" data-end=\"3889\">\n<p data-start=\"3853\" data-end=\"3889\">Freedom of residence within the EU<\/p>\n<\/li>\n<li data-start=\"3890\" data-end=\"3928\">\n<p data-start=\"3892\" data-end=\"3928\">Diplomatic and consular protection<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3930\" data-end=\"4076\">Most of the legal acts in this area are <strong data-start=\"3970\" data-end=\"4022\">decisions and directives of the European Council<\/strong>, which generally come into force upon EU accession.<\/p>\n<hr data-start=\"4078\" data-end=\"4081\" \/>\n<p data-start=\"4083\" data-end=\"4131\"><strong data-start=\"4083\" data-end=\"4129\">Initial, provisional, and final benchmarks<\/strong><\/p>\n<p data-start=\"4133\" data-end=\"4279\">Chapter 23 \u2013 <strong data-start=\"4146\" data-end=\"4182\">Judiciary and Fundamental Rights<\/strong> was officially opened on <strong data-start=\"4208\" data-end=\"4228\">18 December 2013<\/strong> at the Intergovernmental Conference in Brussels.<\/p>\n<p data-start=\"4281\" data-end=\"4637\">The initial benchmark for Montenegro was the <strong data-start=\"4326\" data-end=\"4359\">preparation of an action plan<\/strong> outlining the most important obligations in the chapter. The <strong data-start=\"4421\" data-end=\"4451\">Action Plan for Chapter 23<\/strong> was adopted by the Government on <strong data-start=\"4485\" data-end=\"4501\">27 June 2013<\/strong>, based on the recommendations of the Analytical Review Report, which assessed the alignment of Montenegro\u2019s legal system with EU law.<\/p>\n<p data-start=\"4639\" data-end=\"4849\">After completing the first phase, which set short-term priorities, the Action Plan was adapted and adopted on <strong data-start=\"4749\" data-end=\"4769\">16 February 2015<\/strong> to more concretely define <strong data-start=\"4796\" data-end=\"4832\">medium- and long-term priorities<\/strong> in Chapter 23.<\/p>\n<p data-start=\"4851\" data-end=\"5348\">The initial EU <strong data-start=\"4866\" data-end=\"4885\">Common Position<\/strong> from <strong data-start=\"4891\" data-end=\"4908\">December 2013<\/strong> defined <strong data-start=\"4917\" data-end=\"4946\">45 provisional benchmarks<\/strong>, guiding the work of relevant state bodies and actors. These benchmarks included concrete obligations in judicial reform, anti-corruption (with focus on high-level corruption), and protection and promotion of fundamental rights. Most benchmarks focused on improving the legislative and institutional framework according to EU standards, while some addressed establishing an initial results baseline.<\/p>\n<p data-start=\"5350\" data-end=\"5805\">By fulfilling provisional benchmarks, Montenegro became eligible for the <strong data-start=\"5423\" data-end=\"5443\">final benchmarks<\/strong>. At the <strong data-start=\"5452\" data-end=\"5500\">Intergovernmental Conference on 26 June 2024<\/strong> in Brussels, Montenegro received a positive assessment report on meeting the provisional benchmarks (IBAR), marking the start of a new negotiation phase. The <strong data-start=\"5659\" data-end=\"5708\">Provisional EU Common Position for Chapter 23<\/strong> was also adopted, supplementing the initial Common Position and defining the final benchmarks.<\/p>\n<hr data-start=\"5807\" data-end=\"5810\" \/>\n<p data-start=\"5812\" data-end=\"5974\">The <strong data-start=\"5816\" data-end=\"5865\">Provisional EU Common Position for Chapter 23<\/strong> defines three final benchmarks Montenegro must meet to achieve internal readiness for closing the chapter:<\/p>\n<ol data-start=\"5976\" data-end=\"6515\">\n<li data-start=\"5976\" data-end=\"6189\">\n<p data-start=\"5979\" data-end=\"6189\">Montenegro implements a <strong data-start=\"6003\" data-end=\"6036\">comprehensive judicial reform<\/strong> in line with EU law and European standards on impartiality, independence, accountability, efficiency, professionalism, access to justice, and quality.<\/p>\n<\/li>\n<li data-start=\"6190\" data-end=\"6317\">\n<p data-start=\"6193\" data-end=\"6317\">Montenegro establishes <strong data-start=\"6216\" data-end=\"6281\">strong and effective systems to prevent and combat corruption<\/strong>, including high-level corruption.<\/p>\n<\/li>\n<li data-start=\"6318\" data-end=\"6515\">\n<p data-start=\"6321\" data-end=\"6515\">Montenegro <strong data-start=\"6332\" data-end=\"6363\">protects fundamental rights<\/strong> in law and practice and is fully prepared, upon accession, to apply the <strong data-start=\"6436\" data-end=\"6479\">Charter of Fundamental Rights of the EU<\/strong> and other relevant EU legal acts.<\/p>\n<\/li>\n<\/ol>\n<hr data-start=\"6517\" data-end=\"6520\" \/>\n<p data-start=\"6522\" data-end=\"6561\"><strong data-start=\"6522\" data-end=\"6559\">Plan for meeting final benchmarks<\/strong><\/p>\n<p data-start=\"6563\" data-end=\"6864\">The Government adopted the <strong data-start=\"6590\" data-end=\"6637\">Action Plan for fulfilling final benchmarks<\/strong> on <strong data-start=\"6641\" data-end=\"6658\">25 April 2025<\/strong>, marking a key step in Montenegro\u2019s EU accession process. The document defines specific activities to fulfill remaining obligations in judicial reform, anti-corruption, and fundamental rights protection.<\/p>\n<p data-start=\"6866\" data-end=\"7178\">Completion of this Action Plan will satisfy obligations under the final benchmarks defined by the <strong data-start=\"6964\" data-end=\"7001\">EU Common Position for Chapter 23<\/strong>. The <strong data-start=\"7007\" data-end=\"7034\">deadline for completion<\/strong> is the <strong data-start=\"7042\" data-end=\"7067\">third quarter of 2026<\/strong>, in line with the Government\u2019s plan to fulfill all commitments under the European agenda by the end of 2026.<\/p>\n<hr data-start=\"7180\" data-end=\"7183\" \/>\n<p data-start=\"7185\" data-end=\"7256\"><strong data-start=\"7185\" data-end=\"7254\">Institutions\/organizations participating in the negotiating group<\/strong><\/p>\n<p data-start=\"7258\" data-end=\"7406\">Negotiations for Chapter 23 have been conducted through the <strong data-start=\"7318\" data-end=\"7403\">Negotiating Working Group (NWG) for Chapter 23 \u2013 Judiciary and Fundamental Rights<\/strong>.<\/p>\n<ul data-start=\"7408\" data-end=\"7761\">\n<li data-start=\"7408\" data-end=\"7475\">\n<p data-start=\"7410\" data-end=\"7475\">The first NWG was formed by the Government on <strong data-start=\"7456\" data-end=\"7472\">8 March 2012<\/strong>.<\/p>\n<\/li>\n<li data-start=\"7476\" data-end=\"7563\">\n<p data-start=\"7478\" data-end=\"7563\">Due to staffing and institutional changes, the NWG has been modified several times.<\/p>\n<\/li>\n<li data-start=\"7564\" data-end=\"7761\">\n<p data-start=\"7566\" data-end=\"7761\">The current NWG was established by the Government on <strong data-start=\"7619\" data-end=\"7638\">24 January 2024<\/strong> (Official Gazette of Montenegro, no. 10\/24) and updated on <strong data-start=\"7698\" data-end=\"7714\">6 March 2025<\/strong> (Official Gazette of Montenegro, no. 32\/25).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"7763\" data-end=\"7846\">The NWG has <strong data-start=\"7775\" data-end=\"7789\">44 members<\/strong> (41 from state institutions and 3 from civil society).<\/p>\n<p data-start=\"7848\" data-end=\"7877\">State institutions include:<\/p>\n<ul data-start=\"7878\" data-end=\"8884\">\n<li data-start=\"7878\" data-end=\"7971\">\n<p data-start=\"7880\" data-end=\"7971\">Cabinet of the Deputy Prime Minister for Political System, Judiciary, and Anti-Corruption<\/p>\n<\/li>\n<li data-start=\"7972\" data-end=\"7995\">\n<p data-start=\"7974\" data-end=\"7995\">Ministry of Justice<\/p>\n<\/li>\n<li data-start=\"7996\" data-end=\"8037\">\n<p data-start=\"7998\" data-end=\"8037\">Ministry of Human and Minority Rights<\/p>\n<\/li>\n<li data-start=\"8038\" data-end=\"8092\">\n<p data-start=\"8040\" data-end=\"8092\">Ministry of Social Welfare, Family, and Demography<\/p>\n<\/li>\n<li data-start=\"8093\" data-end=\"8116\">\n<p data-start=\"8095\" data-end=\"8116\">Ministry of Finance<\/p>\n<\/li>\n<li data-start=\"8117\" data-end=\"8141\">\n<p data-start=\"8119\" data-end=\"8141\">Ministry of
